We at MyTeleMD Inc  respects your privacy. We wish to use this opportunity to inform you of our commitment to protecting your privacy through this Privacy Policy (“Policy”). This policy  summarizes /describes the type of information  that we may collect and how MyTeleMD Inc retains, uses, discloses, destroys or  protects Information including medical and health related information, as we provide services to you.

We commit to complying to applicable provincial/state or federal privacy legislation as well as to this policy.

Authorized physicians are to abide by the Professional requirements  and privacy legislations which governs their professional as it relates to the information management—collection, use, and retention  in the course of providing services through the MyTeleMD  Platform.

You can ask the Authorized physician attending to you, how they will handle your information.

Collection & Use of Information

MyTeleMD only collects and uses the minimum pertinent information required to provide you with the services that you require. As previously stated, the authorized physician is responsible for the information that the collect, use, disclose, retain as custodians of Health information. They (authorized physicians) must comply with the privacy legislation and medical record-keeping obligations to which they are subject to.

An Authorized Physician decided whether to collect information and what information they collect as summarized below in their interactions with a user.

Services– Medical

While using the MyTeleMD platform, note that the Authorized Physicians who will be attending to you /your dependent, can view Information about you or your dependent or family member. They information that they will have access to, may include your profile/medical data or that of your dependent(which you entered on the platform), the details of the questionnaire you/your dependent  completed prior to the consultation, all aimed at providing you or your dependent with no emergent medical care.

The authorized physicians must comply with the privacy legislation and medical record-keeping obligations to which they are subject by their profession during your interaction with them. They will make clinical notes during their encounter with you on our platform and would decide what information they share with you.

Information Provided on the MyTeleMD Platform

The information you provide will be used to create a user account for you and to personalize your experience while using the MyTeleMD app. We first confirm your jurisdiction as well as your payment method—public, private insurance or private personal payment.

Disclosure and Consent : Telemedicine and Telehealth

Introduction:

Telemedicine and telehealth services (hereafter, “telemedicine”) involve remote interactions through telecommunication technologies between a health care provider and a patient at a different location, in order to provide real-time evaluation, diagnosis, consultation, and treatment of a health condition. The technologies may involve the use of telephone, video, or other two-way communication mediums, electronic patient portals, remote transmission and review of health information, or other methods.

Consent for Telemedicine Treatment:

I voluntarily request and give permission (consent) to MyTeleMD, Physicians operating through the MyTeleMD  platform and any associates as they may deem necessary, to provide me medical and/or health care through telemedicine technology and services.

I understand that the Physicians using the MyTeleMD platform, may:

Have their practice in a different location from where I reside in .
Not have the opportunity to perform an in-person physical exam of me at the time my telemedicine services are provided and may ask that I visit my nearest emergency room or regular physician./walk in clinic.
Fully rely on information  that I provide at. The time of registration, questionnaire completed and during our telemedicine services appointment
I understand that the Physicians using the MyTeleMD platform provide advice, recommendations, and/or decisions may be based on factors not within their control, such as incomplete or inaccurate data provided by me .

I understand that if telemedicine services are interrupted due to a technology problem or equipment failure or other reason that  I may need to have an in-person medical evaluation with a health care provider located in my area.

I understand that the level of care provided by physicians under the MyTeleMD platform is to be the same level of care that is available to me through an in-person medical visit. If the physician determines that the telemedicine services will not adequately address my medical needs, the physician may require me to schedule and attend an in-person appointment with my health care provider.

I understand that if I experience any urgent medical symptom(s) or condition(s) after a telemedicine session, I should go directly to the nearest emergency room.

I understand that I am responsible for any copayment or deductible amounts associated with telemedicine visits, in accordance with my insurance company’s policies. If my insurance company does not cover telemedicine visits, I understand I am financially responsible for the cost of such visits.

I have been given an opportunity to ask questions about the telemedicine services to be provided to me. I understand the risks and hazards involved with telemedicine services. I believe that I have enough information to give informed consent to receive telemedicine services under the MyTeleMD platform.

Notice concerning complaints

I acknowledge that complaints about physicians operating on this platform, who provided service to me, may be reported directly to the medical licensing body in my jurisdiction:

Disclosing Information

MyTeleMD will not disclose, share, or  sell or rent your Information with/ to any third party (except to the extent we disclose to Authorized Physicians and in compliance with regulatory and legal requirements as set out in this Policy), except with your consent, or to the extent necessary, in our good faith judgment, to: comply with applicable laws or regulations, respond to a subpoena, order, or similar obligation to produce information; establish or exercise MyTeleMD Inc’s legal rights or defend against legal claims; or investigate, detect, suppress, prevent or take action regarding illegal or prohibited activities, suspected fraud, situations involving potential threats to the reputation or safety of any person.

We may disclose Information for the purposes of the due diligence required for or for the completion of a transaction such as a merger, acquisition or asset sale. We will comply with any applicable legal requirements, including notice requirements, that apply to such transactions.

Retaining and disposing of Information

Unless otherwise specified by us, MyTeleMD  will retain your Information on our Platform on your behalf until such times as you or we terminate your User Account.

Prior to the termination, you have the opportunity to print or make copies of your Information subject to the following. To ensure that Authorized Physicians may exercise any authority they have to withhold Information they compile in connection with Healthcare Services from patients under the law, you will be required to request any access you would like to notes made by an Authorized Physician about your consultation from the Authorized Physician. As mentioned above, MyTeleMD Inc is not the custodian of Information held on the MyTeleMD Inc Platform; rather it holds Information on behalf of Users or Authorized Physicians. On termination of your User Account, once you have been given the opportunity to print or make copies of your Information, we will delete the Information associated with your User Account.

Access to & Correction of Information.

You can access and correct the information you provided about yourself or your dependent by going to the profile section of the app   after logging into your user account.  Information about your consult with a physician can only be access by requesting it directly from the physician, MyTeleMD does, and its associates does not have access to this information.

Your information security is our priority. We store your information in electronic format within your country of residence at the time of the consult (e.g Canada), using computer systems with restricted access .

The MyTeleMD Inc website/ Platform may contain links to other websites that we do not own or operate. We are not by any means endorsing these links or  websites. We strongly encourage you to review the privacy policies applicable to any site you visit. This Policy does not apply to such linked pages or other sites, and we are not responsible for the content or practices of any linked websites or their operators which are provided solely for your convenience.

Definitions

“Authorized Physician” means a physician who is registered to practice medicine in a Province or Territory of Canada or your country of residence and is permitted to provide Healthcare Services and through the MyTeleMD Inc Platform.

“Data” means information collected or compiled through the MyTeleMD Inc Platform which has been de-identified.

“De-identify” in relation to PHI, means to remove information that identifies the individual or for which it is reasonably foreseeable in the circumstances that it could be utilized, either alone or with other information, to identify the individual.

“Device” means a mobile or desktop device owned or controlled by a User and used to access MyTeleMD.
